Global Legal grounds of Intellectual Property Rights
TRIP (Trade Related Aspects of Intellectual Property Rights) Agreement is to decrease impediment in international trade. Obligations of its member countries – to be conformed to TRIP minimum standard. In the implementation; to assure the balance of minimum standard of Intellectual Property Rights protection and public needs.
As an influence from global trade where the business development is sharply increasing, the Intellectual Property Rights protection law is in the requirement to revise some amendments poured forth in the law, the involvement of Indonesia in ratifying convention on the establishment of world trade organization which also comprising trade aspects related to Intellectual Property Rights or commonly recognized as TRIPs agreement, as endorsed under Law No. 7 year 1994 regarding the legalization of Agreement Establishing the World Trade Organization, it also giving influence in the history of the development of Intellectual Property Rights protection system in Indonesia. TRIPs agreement comprises the obligation of its member countries to adjust National Law in Intellectual Property Rights with provisions in the TRIPs agreement. TRIPs agreement comprises the protection norms and standard for human intellectual creations and places international agreements in Intellectual Property Rights as the foundation. Moreover, the TRIPs agreement is firmly organizing the implementation rules of law enforcement in intellectual property rights.
Ratification of the provisions has motivated the involvement of Indonesia to ratify Paris Convention for the protection of Industrial Property legalized under Presidential Decision of the Republic of Indonesia No. 15 year 1997 and Trademark Law Treaty legalized under Presidential Decision of the Republic of Indonesia No. 17 year 1997. By means of the ratified international agreements by the Indonesian government, it comprises the obligation to adjust the existing Trademark Law with the provisions in the ratified international agreements.
